Two Moms Deathly Ill. James Malinchak Notifies
his Lawyer
Email I received 3/22/2011 from highly respected
leadership speaker John Hersey, CSP and his wife Beverly Belury

Heard you were upset about something re: Malinchak.
We met him in May/June 2008 in Las Vegas
(I think you were there). We signed up for his coaching. Within 2-3
weeks we realized both our Mothers were quite ill (both passed away
in early 2009) and we just wouldn't be able to fulfill our
commitment. We approached James about a refund and he replied to my
phone call and email by sending me a copy of the clause in the
contract stating it was not cancelable. That's all he sent, the
clause. And, he cc'd his lawyer. We knew about the clause but
thought he might show a touch of compassion. Too much to expect. We
payed, attended 1 meeting at his home and that was it. What a huge
waste of money, time and emotion. All he cares about is the money.

Commentary:
Hmmmmm. Let's recap this. They paid
approximately $13,000.00. Were in the program only two weeks and not
only found that one of their mothers was deathly ill, but BOTH OF
THEIR MOTHERS WERE DEATHLY ILL AND BOTH DIED WITHIN THE YEAR. They
get a heartless reply to their request with a copy to James
Malinchak's attorney.
Was James Malinchak within his legal rights. Probably yes. Is this a
low life, scumbag thing to do to people ABSOLUTELY!
James Malinchak. You don't have to do this, but it would be very
nice if you refunded this money immediately and when you do I will
be glad to post notice of it here. Oh, and just a reminder.
Pay the money to the charity that you owe!
